1. Acceptance of Terms

By registering for or using Designvest, you agree to these Terms and our Privacy Policy. If you do not agree, you may not access or use our services.

2. Eligibility

• You must be at least 18 years old to use Designvest.
• By using our services, you confirm that you have the authority to enter into this agreement and comply with all applicable laws.

3. Services Provided

Designvest provides tools and services to convert business ideas into professional design assets, including logos, visuals, and more. Services may include:

• Access to design templates and tools.
• Collaboration features for startups, investors, and designers.
• Project management and design asset delivery.

4. User Responsibilities

As a Designvest user, you agree to:

• Provide accurate and up-to-date information during registration.
• Use the platform only for lawful purposes.
• Not upload or share content that is harmful, offensive, or infringes on intellectual property rights.
• Maintain the confidentiality of your account credentials.

5. Prohibited Activities

You agree not to:

• Reverse-engineer or interfere with the platform’s functionality.
• Use automated tools, bots, or scripts to interact with the platform.
• Upload content that contains malicious code or violates any laws.

6. Intellectual Property

a. Platform Ownership

• All tools, templates, features, and software provided by Designvest are the exclusive property of Designvest and are protected by applicable intellectual property laws. Users may not copy, distribute, or modify any platform resources outside their intended use on the platform.

b. User-Generated Content

• Content created by users on the Designvest platform, including AI-generated visuals and text, remains the property of Designvest until the user holds a valid, paid account.
• Users with an active, paid subscription at the time of creation are granted full usage rights to their AI-generated content. This includes the right to use, modify, and distribute the created content for personal or commercial purposes.
• For users without a paid subscription, any created content may only be used for personal or non-commercial purposes and is subject to further licensing terms from Designvest.

c. Rights to Uploaded Assets

• Users retain full ownership of original materials they upload to the platform (e.g., logos, designs, or text files) and grant Designvest a non-exclusive, royalty-free license to process and display this content as necessary for service delivery.

d. Retention of Designvest Rights

• Designvest reserves the right to use anonymized versions of AI-generated outputs for marketing, demonstration, or platform improvement purposes unless otherwise explicitly requested by the user.

e. Content Removal and Transfer

• Upon account termination or cancellation of a paid subscription, users may retain a copy of any AI-generated content created during their subscription period.
• Users who wish to delete their data or revoke usage rights for specific content must submit a request to mail@designvest.org.

7. Payment and Billing

• Some services or features may require payment. Fees and subscription plans will be displayed at the time of purchase.
• Payments are non-refundable unless stated otherwise.
• You agree to provide accurate billing information and authorize Designvest to charge your payment method for applicable fees.

8. Termination

Designvest reserves the right to suspend or terminate your account at its discretion if you violate these Terms. Upon termination:

• Access to your account and associated data may be revoked.
• You may request data deletion by contacting mail@designvest.org.

9. Disclaimers

• Designvest provides its services on an “as-is” basis. We do not guarantee uninterrupted or error-free access.
• We disclaim liability for any loss or damage resulting from the use of our platform.

10. Limitation of Liability

To the fullest extent permitted by law, Designvest is not liable for:

• Indirect, incidental, or consequential damages arising from your use of the platform.
• Loss of data or profits, regardless of foreseeability.

11. Indemnification

You agree to indemnify and hold Designvest harmless from any claims, liabilities, or expenses arising from your use of the platform, including legal fees.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Users will be notified of updates via email or platform announcements. Continued use of the platform constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the jurisdiction where the company is based at the time the dispute arises. Any disputes will be resolved in the courts of that jurisdiction.
